These Terms of Service govern the access to and use of Bhalakatha Foundation Trust
’s (“Trust” / “We”/ “Our”) ‘Shrutilipi’ website (https://shrutilipi.in/) (“Website”),
the ‘Shrutilipi’ application available on Android (“Application”) by any person
(“User”/“You”/“Your”).
Trust, on its Website/Application, primarily facilitates a User to :
- Upload and publish literary works such as books, stories, poems, articles, essays, travelogues, personal anecdotes, science fiction, health, fashion, culture, and religion-related content, as well as biographies, memoirs, interviews, reviews, children's literature, historical narratives, folklore, academic papers, philosophical writings, environmental essays, spiritual reflections, satire, and translations etc. and includes cover images/ other images used in each such work (“Published Work(s)”) on the Website/Application in four languages like English, Hindi, Odia and Bengali and the User doing so is hereinafter referred to as an “Author”, and/or
- consume such Published Works as well as any such works published by Shrutilipi itself (referred to as “Shrutilipi Content”) on the Website/ Application and the User doing so is hereinafter referred to as a “Reader”. Published Works and Shrutilipi Content shall together be referred to as “Content”.
In order to enrich the User’s experience while utilizing the Website/Application, "Shrutilipi" may offer ancillary features (“Features”) including but not limited to (i) submitting reviews on the Content, (ii) setting a username, profile picture and entering other details on the User’s profile. All material uploaded by the User while using these ancillary features shall be referred to as (“Inputs”).
All the above features offered by the Trust through its Website/Application shall be referred to as (“Services”).
By accessing or browsing through the Website/Application and using the Services provided therein, you expressly acknowledge and agree to be legally bound by these Terms of Service, which must be read in conjunction with our Privacy Policy (“Privacy Policy”). You further affirm and represent that you are at least 18 (eighteen) years of age and possess the legal authority and capacity to enter into a binding agreement with the Trust.
In the event that you are below 18 (eighteen) years of age, it is mandatory that you obtain prior consent from your parent(s) or duly authorized legal guardian(s). Such parent(s) or guardian(s) shall bear full responsibility for your acceptance of and adherence to these Terms of Service. If requested by the Trust , you or your parent(s)/guardian(s) must promptly furnish proof of such consent.
If you are a minor and fail to obtain the required consent from your parent(s) or duly authorized legal guardian(s), you shall be obligated to immediately discontinue, cease, and refrain from any further access to or use of the Website/Application and all associated Services offered there in.
This document constitutes an electronic record as defined under the provisions of the Information Technology Act, 2000 and the applicable rules framed there under. As such, no physical or digital signature is necessary to render these Terms of Service legally binding upon the User. These Terms of Service, read together with the Privacy Policy, have been drafted and published in accordance with the requirements set forth under Rule 3(1)(a) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time.

- consume such Published Works as well as any such works published by Shrutilipi itself (referred to as “Shrutilipi Content”) on the Website/ Application and the User doing so is hereinafter referred to as a “Reader”. Published Works and Shrutilipi Content shall together be referred to as “Content”.

Accuracy : The User is required to provide full, complete, and accurate information at the time of registering on the Website/Application. It is the User’s responsibility to promptly notify the Trust in writing (including via email, which is permitted) of any changes, updates, or corrections to the information previously submitted. Additionally, the User must refrain from misrepresenting themselves in any manner, including impersonating any other individual, whether living or deceased.
ConfidentialityConfidentiality: The User shall be solely responsible for maintaining the confidentiality, security, and integrity of their account credentials, including but not limited to usernames, passwords, and any other login information. The User further agrees to accept full responsibility for all activities and actions carried out through their account while using the Services, whether authorized or unauthorized.
Ownership : The User shall ensure that all copyrights related to the Published Works uploaded on the platform by the user are either fully owned by the User or have been validly assigned or licensed to the User. The User also affirms that the Published Works are entirely original in nature and do not infringe upon or violate any rights of third parties. This includes, but is not limited to, patents, trademarks, copyrights, other intellectual or proprietary rights, or any personal or personality rights belonging to any third party.
Guidelines and Policies To comply with the Content Guidelines (provided below) as well as all other policies and guidelines issued by the Trust throughout the Website/Application, including the Policy and Safety guidelines related to the use of the Website/Application.
ReproductionReproduction : Do not reproduce any content from the Shrutilipi Website or Application and publish it on any other platform or medium without prior written permission or proper authorization from the Trust, regardless of whether it is for commercial purposes or otherwise.
Permissions : Trust shall be granted the right to carry out the following activities for as long as the User's account remains active or until the User’s Published Works continue to be made available on the Website and/or Application, whichever occurs earlier :
• Display the User's name and/or username publicly for the purpose of attributing authorship of the Published Works uploaded by the User on the Website/Application of Trust ;
• The User hereby grants to Trust, on a non-exclusive, worldwide, royalty-free, and transferable basis, the irrevocable right and license to use, reproduce, adapt, modify, publish, process, publicly perform, publicly display, distribute, and transmit the User’s Published Works, including any associated name, username, likeness, or other identifying information provided by the User in connection therewith.
• This license is granted for the purpose of enabling Trust to distribute, disseminate, and make the Published Works, and any derivative works thereof, available through any and all forms of media, modes of transmission, or distribution methods, whether now known or hereafter devised. This includes, without limitation, the right to reproduce, convert, or adapt the Published Works into audio and/or video formats; to use the same in connection with Trust's website, mobile application, and associated services; and for marketing, promotional, and publicity purposes through official Trust channels, including social media platforms, and affiliated third-party channels or partners of the Trust.
• It is hereby clarified that the Trust shall also have the right to market and promote the User’s Published Works in various forms, including, but not limited to, creating excerpts or snippets from the Published Works; converting such Published Works and/or excerpts into audio and/or video formats; combining such Published Works and/or excerpts with works of other authors available on the Website/Application; and compiling and publishing curated lists, such as “Top Authors” or similar features, on the Website/Application, in any manner that Trust deems appropriate.
Authenticity: At Shrutilipi, we are dedicated to digitizing precious manuscripts, including celebrated compositions and ancient texts in the four languages we focus on. This important task is overseen by our expert editorial committee to ensure authenticity and excellence. We warmly encourage writers to submit their original works only. Kindly refrain from uploading creations by already renowned authors, as such submissions will not be accepted. Let this platform be a space where your unique voice finds its place in the digital literary archive.
Support: If you're a writer facing difficulties uploading your work through the app, require technical support, or wish to have your writing published by the Shrutilipi team, we're here to help. Feel free to reach out—your voice matters, and we're committed to bringing your words to the world. If you feel the category for your article isn’t available on the app, don’t worry — you can request a new one! We're happy to consider creating it for you. To ensure quality and relevance, a new category will be published only once we receive at least five articles prepared under that theme. Together, let’s shape a richer literary landscape!
Illegal Activities : Do not use the Services to engage in any illegal activities or to solicit, encourage, or facilitate the performance of any illegal activity or any act that infringes upon the rights of any third party.
Virus : Do not upload any material which contains software viruses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource used to provide the Services.
Non-Solicit : Do not advertise or solicit any products or services, including offers with respect to a User’s Published Works in any manner on the Website/Application, including by publishing such messages as Published Works or through the Features available on Shrutilipi.
Spam: Do not contact or target Users through any form of communication, including via Published Works or by using the Features, in a manner that constitutes spamming or with the intention of persuading Users to take down their Published Works from the Website/Application, or to encourage them and/or their Published Works to migrate to other content platforms, or to initiate conversations with Users for any of the aforementioned purposes. Security:
• Do not probe, scan, or test the vulnerability of the Website/Application;
• Do not disrupt or breach any security or authentication measures, or attempt to bypass or circumvent the navigational structure of the Website/Application of Shrutilipi or its network;
• Do not use any manual or automated tools, software, devices, or other processes to “crawl,” “scrape,” or “spider” any part of the Website/Application;
• Do not use cheats, exploits, automation tools, bots, hacks, or any unauthorized third-party software to interfere with or alter the Services, or to gain any unfair or undue advantage from the Services or their features in any way; and
• Do not impose an unreasonable or excessive load on the Trust’s infrastructure.
Access: To access and use the Services solely for the User’s personal and non-commercial purposes, except as otherwise permitted on the Website/Application, and not to access the Website/Application or obtain any Content through any means other than those expressly allowed. Unfair Conduct: Do not engage in any unfair practices, including but not limited to using unauthorized methods to earn from the Website/Application, or participating in any other fraudulent or wrongful activities on the Website/Application.
User Data: Users shall not attempt to trace, access, store, collect, or exploit any information related to another User. Any such unauthorized use, including the gathering or misuse of personal or identifiable data of others, is strictly prohibited and considered a violation of privacy and trust within the platform.
Trademark and Design: Users shall not use, misuse, or misappropriate the trademark ‘Shrutilipi’, any logos, or any design elements of the Website/Application that are owned or utilized by the Trust. Any unauthorized use of these distinctive brand assets, in any form or for any purpose not expressly permitted, is strictly prohibited and shall be considered a violation of the Trust’s intellectual property rights.
Non-Disparagement: Users shall refrain from engaging in any act, expression, or conduct that could tarnish the reputation, dignity, or public image of the Trust or the Website/Application Shrutilipi, or bring them into disrepute in any manner. RIGHTS OF THE TRUST User acknowledges the following rights of the BHALAKATHA FOUNDATION TRUST regarding its' website /application Shrutilipi :
Article Submission & Publication Policy : Submitting an article does not guarantee immediate publication. Once an article is uploaded, it undergoes a thorough review by the Shrutilipi’s editorial team (admin) to ensure it aligns with our editorial standards and publication guidelines. Only articles that meet all required criteria will be approved. Upon approval, the article will be published on both the website and mobile app within three working days of submission.
Remove Content: The Trust reserves the right, at its sole discretion or as mandated by law, to remove any Published Works or Inputs from Shrutilipi that it considers objectionable, infringing, or otherwise inappropriate.
Suspension/Termination : Trust has the right to restrict/suspend/terminate the account of any User to access all or part of the Services, at its discretion, including for violation by the User of these Terms of Service.
Intellectual Property: The Service, along with all its components—including the Website/Application, logos, trademarks, brand names, service marks, domain names, designs, and graphics—created and developed by the Trust, as well as all other distinctive brand elements associated with the Website/Application, are the exclusive property of the Trust. All intellectual property rights vested in these assets are solely owned and held by the Trust.
Trust Content: All Trust Content, whether owned by the Trust or its licensors, remains the exclusive property of the Trust. No rights or ownership in such content are transferred to Users, except as expressly granted for the legitimate use of the Service in full compliance with these Terms of Service.
Personal Data : Trust shall process the personal data of the Users submitted in accordance with the Privacy Policy.
Legal Disclosure: The Trust reserves the right to disclose the details of any User, as well as any information related to Published Works or Inputs, and to take any necessary actions as required by law or pursuant to a lawful order issued by authorized government agencies investigating cyber security incidents.
Enhance Security Measures: The Trust may implement enhanced security protocols and technical safeguards periodically, as deemed appropriate, to effectively prevent and address any violations of copyright belonging to Users or third parties, ensuring robust protection of intellectual property rights.

Published Works/Inputs Uploaded on the Website/Application Must Comply with the
Following :
• Not Be Objectionable or Unlawful : Users shall refrain from publishing any Published Works or Inputs that are grossly harmful, infringing upon others’ rights, harassing, blasphemous, defamatory, obscene, pornographic, libelous, invasive of another’s privacy, hateful, racially or ethnically offensive, disparaging, or promoting unlawful activities such as money laundering or gambling, or that violate any laws in any manner whatsoever.
• Not Be Against National Interest : Content that threatens the unity, integrity, defense, security, or sovereignty of India, damages friendly relations with foreign states, disturbs public order, incites the commission of any cognizable offense, obstructs the investigation of any crime, or insults any other nation is strictly prohibited.
• Protect Minors: Users must ensure that no Published Works or Inputs are uploaded which could in any way harm, exploit, or negatively influence minors.
• Not Be Misleading or Offensive: Content that deceives or misleads readers regarding the origin or authenticity of the material, or that communicates information that is grossly offensive, menacing, or intended to intimidate, is strictly forbidden.
• Originality and Authenticity: Users must ensure that all Published Works or Inputs are their own original creations and must not be copied, reproduced, or derived from any other books, journals, writings, or external sources. Additionally, content generated wholly or partially by artificial intelligence (AI) tools is strictly prohibited, affirming the genuine and authentic nature of every submission.
All Published Works/Inputs must adhere to these guidelines to maintain the integrity, safety, and lawful use of the Website/Application

The Trust reserves the unfettered right to assume the exclusive defense and control of any matter subject to indemnification by the User, and in such event, the User agrees to cooperate fully with the Trust in the defense of such claims. The Trust further reserves the right to recover from the User any costs or expenses incurred in connection with such legal proceedings.
No Indirect Liability: The Trust expressly disclaims any and all liability for special, incidental, indirect, consequential, or punitive damages, losses, or costs incurred by any User or third party arising out of or in connection with the provision of Services or the use of the Website/Application by any person, including other Users.
